Protecting the Name and the Public: A Formal Notice Regarding the Bophuthatswana Civic/Civil Movement...

Dear Members of the Public,


This is a formal public notice concerning Mr. Kagiso Monyadiwa and recent conduct that has damaged my reputation, misled the public, and misrepresented events surrounding the formation and promotion of an organisation he described as the Bophuthatswana Civic/Civil Movement.


Background


Mr. Monyadiwa was introduced to me by Mrs. Palesa Diutlwileng as a founder and leader of the Bophuthatswana Civic Movement. Because of the organisation’s name and its historical resonance, I welcomed him and agreed to host him on Radio Bop Africa so he could present the project to the public. I made clear from the outset that I am apolitical and that my radio station would not be used for partisan activity.


Broadcasts and Misrepresentations


- During an initial interview Mr. Monyadiwa asserted that the movement was fully registered. I offered further airtime and asked that he bring colleagues to address outstanding issues.

- Midway through the second interview, Mr. Monyadiwa and his colleagues announced a name change to “Bophuthatswana Civil Movement,” said they had received requests to convert the movement into a political party, solicited public support, announced a membership fee, and published a bank account for payments.

- Following those broadcasts I raised questions about registration. Although Mr. Monyadiwa initially maintained the organisation was registered, subsequent enquiries (by me and through Mrs. Diutlwileng) confirmed it had not been registered at the time it was promoted. A bank account in the name “Bophuthatswana Civil Movement Party” had been opened at FNB Mahikeng. Two co‑signatories later told me they were presented with preprepared paperwork at the bank for their signatures.


My Response and Protective Measures


- When I established the organisation was not lawfully constituted, I immediately advised Mr. Monyadiwa and his colleagues to regularise registration and offered to assist to ensure full legal compliance. I acted in good faith, believing they may have overlooked statutory requirements in the enthusiasm of launching their project.

- To protect the name and prevent opportunistic third‑party registration, I registered both “Bophuthatswana Civic Movement” and “Bophuthatswana Civil Movement” with the CIPC in trust. I registered these entities to preserve the name while Mr. Monyadiwa completed the proper legal processes and challenged him to provide proof of lawful compliance; only then would I transfer control.


Escalation, Evasion and False Accusations


- Rather than engage constructively, Mr. Monyadiwa became evasive, blocked direct communication, and preferred intermediaries. A mediation meeting he set was cancelled by him minutes before it was due to start, with a message that the meeting was “based on lies.” Thereafter he circulated falsehoods about me and Radio Bop Africa, accusing me of attempting to steal his vision and disparaging my credibility. He continues to assert his organisation is legitimately registered despite contrary evidence.


Evidence and Key Facts


- I am apolitical and made this clear to Mr. Monyadiwa and his colleagues.

- Evidence from the FNB Mahikeng branch manager indicates that the documentation submitted to open the bank account was inappropriate, yet an account was opened and used to solicit funds from the public under false pretenses.

- At the time of the radio interviews, Mr. Monyadiwa and his colleagues knew the organisation was not registered but presented it as such to the public.

- Mr. Monyadiwa solicited donations and induced members of the public to deposit funds into an operation he knew was not lawfully constituted. He subsequently requested money from me, claiming it was an IEC registration fee, despite earlier representations that the organisation was already registered. This request offended me and demonstrated disregard for my stated apolitical position.

- Cellphone transcripts, witness statements and documentary records corroborate my account and the chronology of events. I will submit this evidence to the relevant authorities. My intent is to protect the public and the integrity of the Bophuthatswana name, not to target Mr. Monyadiwa personally.


Conduct Pattern and Concerns


Mr. Monyadiwa’s conduct shows a recurring pattern: evasion of accountability, propagation of unsubstantiated accusations, mobilisation of support based on misleading representations, exploitation of my radio platform to solicit funds, and attacks on my credibility when I sought clarification and lawful compliance. He continues to claim legitimacy for the Bophuthatswana Civil Movement despite documentary evidence to the contrary. He is assisted by several like‑minded individuals who have enabled or participated in these actions and who should also be held accountable where appropriate.


Registration Status and Official Complaints


- Both “Bophuthatswana Civic Movement” and “Bophuthatswana Civil Movement” are registered with CIPC by me, Kealeboga Gift Mogapi; I am the lawful fiduciary officer of these entities, not Mr. Monyadiwa. (CIPC registration numbers are available on our letterhead.)

- Neither entity is registered as a political party. I have verified with Social Development and the IEC and there is no record supporting Mr. Monyadiwa’s claims. The IEC receipt he produced is a reference confirming receipt of an application, not a certificate of registration. I have formally lodged a complaint with the IEC about attempts to use a name similar to the entities I lawfully registered.


Purpose of this Notice


- To present the full factual record so the public can judge objectively rather than rely on a one‑sided narrative.

- To rebut false and damaging claims made against me and my businesses.

- To invite media outlets that may have been misled to give Mr. Monyadiwa an opportunity to respond.

- To confirm that I attempted resolution through direct communication and mediation, but those avenues were obstructed or rejected.


Legal and Public Recourse


I am taking appropriate legal action to address defamatory and misleading conduct directed at me and my enterprises. I invite any interested party, media outlet, or legal authority to examine the evidence I possess.


A Personal Note


I do not intend to vilify Mr. Monyadiwa beyond exposing facts I can substantiate. My objective is fairness, truth and accountability. I opened Radio Bop Africa to Mr. Monyadiwa in good faith, acted to protect the public interest when I discovered inconsistencies, and offered lawful assistance to regularise the organisation.


Conclusion


Judge claims by their proof. I prefer documentation over innuendo and facts over rumours. The public deserves both sides of the story.
